General terms and conditions

1. General

1.1 Our General Terms and Conditions apply to all written, electronic (internet), and telephone bookings and are accepted with each booking. We reserve the right to amend the Terms and Conditions.
1.2 The contractual services are governed by the descriptions valid at the time of the event according to our offer.
1.3 Individual agreements only become part of the contract if confirmed by us in writing.
1.4 Drivers Point GmbH is entitled to take photos and other image material (especially videos) of the event and to use them free of charge in promotional brochures and other publications (especially on the internet).

 

2. Conclusion of Contract

2.1 By registering, you make a binding offer to conclude a contract with us.
Your registration can be made in writing or by online registration via the registration form on the DRIVERS POINT homepage. The registration also applies to all participants listed in the registration, for whose contractual obligations you are liable as for your own, provided you have explicitly undertaken such an obligation.
2.2 The contract is concluded by our informal acceptance.

3. Participation Conditions

3.1 The Road Traffic Regulations (StVO) apply on the premises of Drivers Point GmbH.
3.2 During the entire training, the instructions of the instructors must be followed for safety reasons. Participants may be excluded from the event without refund of the course fee in case of serious violations of these instructions or the StVO rules.
3.3 We reserve the right to exclude participants from practical training without refund of the course fee if there is reasonable suspicion of residual alcohol or drug impairment.
3.4 Only vehicles without studded tires may be used in training, except for special trainings on natural ice. Vehicles with so-called trial license plates may be admitted after consultation at registration.
3.5 Only roadworthy and operationally safe vehicles are permitted for training. Special attention must be paid to the manufacturer-recommended tire pressure.
3.6 Generally, participants use their own vehicles, but rental vehicles can also be arranged (please notify timely at registration). Only drivers with a valid driving license for the respective class may participate. Exceptions are multi-phase courses and training for 125cc motorcycles with a valid B license (code 111); furthermore, training on the traffic practice area when accompanied by a valid license holder.
3.7 All courses and trainings are conducted in German. If you do not have sufficient German skills, we recommend bringing a translator at your own expense or an accompanying person with sufficient German knowledge.
3.8 During practical training, carrying additional persons (adults or children) in the car or on the motorcycle/scooter is not recommended; at the customer's request, it is at their own risk and without insurance coverage for passengers only if necessary and after prior coordination with the Driving Safety Center.
3.9 For car training, we recommend sturdy footwear and weatherproof clothing, as training takes place mostly outdoors. For two-wheel training (motorcycles, scooters), protective clothing is mandatory, especially helmet, leather suit or other suitable material suit, gloves, leather boots (or at least ankle-covering motorcycle boots). Sturdy outerwear and ankle-covering shoes are essential. Helmet with protective cover, gloves, as well as elbow and knee protectors are required.

4. Payment Terms

4.1 Please transfer the course fee before the start of the training.
4.2 The course fee does not include possible accommodation and meals.
You consent to the sending of informational materials, promotional brochures, and offers from Drivers Point GmbH regarding all aspects of driving safety as well as to the transmission of your data to affiliated companies for this purpose. You also agree to be contacted via phone, fax, or email about these offers. This consent can be revoked by you at any time in writing.

5. Data Protection

Drivers Point GmbH guarantees compliance with the applicable data protection laws in handling your data.
Your provided data (name, address, date of birth) will be stored and processed electronically for contract fulfillment. By concluding the contract, you also consent to the processing of your data for sending informational materials, promotional brochures, and offers related to driving safety and to transmission to affiliated companies. You also agree to be informed via telephone or email about offers. This consent can be revoked by you at any time in writing.

6. Insurance

6.1 The motor vehicle liability insurance of the vehicle used with an Austrian license plate covers personal, property, and financial damages caused by the participant up to the statutory insurance sum. The prerequisite is that the vehicle is used with the vehicle owner’s consent.

7. Cancellation Policy for the Drivers Point Driving Safety Training GmbH

Paid Cancellation
The participant acknowledges that cancelling an online registration for a driving safety training course with Drivers Point Fahrsicherheitstraining GmbH is subject to fees.

Cancellation for Online Registration


For registrations made online, the following conditions apply:

  • Up to 7 calendar days before the training date: A cancellation fee of 50% of the participation fee will be charged.

  • From 7 calendar days before the training date (including the training day): The full participation fee (100%) must be paid.

Applicability in Special Circumstances
The above regulations apply regardless of the reason for cancellation, including in cases of illness, accident, or other unforeseen events.

Registration through Partner Driving Schools
For registrations made through a participating driving school, only the cancellation policy starting from 7 calendar days before the training date applies.

The driving safety training is carried out in the name and on behalf of Drivers Point Fahrsicherheitstraining GmbH.

8. Cancellations / Non-Use of Contractual Services

8.1 The organizer reserves the right to postpone or cancel trainings (e.g., extreme/dangerous weather conditions, too few participants) without further obligations except refund of the course fee.
8.2 If the event is significantly hindered, endangered, or impossible due to force majeure (e.g., weather conditions, natural disasters, war, civil unrest, strike), both you and we have the right—contrary to the cancellation terms in point 7—to cancel or terminate the event early. In this case, we may demand reasonable compensation for services already rendered (max. the contractual total price).
8.3 If contractually agreed services are not used fully or partially for reasons within your sphere without force majeure, we are entitled to the full contractually agreed total price.

9. Warranty and Performance Disruptions

9.1 We guarantee careful preparation and execution of the events and proper delivery of contractually agreed services. We have the right to remedy by providing equivalent replacement services.
9.2 We assume no liability for disruptions in third-party services merely mediated by us.
9.3 Should disruptions occur, you are obliged to do everything reasonable to help remedy the situation and minimize damage, particularly by reporting complaints immediately to the instructor/representative present. However, our representatives are not authorized to make legal declarations.
9.4 You may demand a reduction of the total contract price for the duration of improper service, unless you culpably fail to notify us promptly. Immediate notification is not required for consumers under KSchG.
9.5 We are liable for damages caused by culpable non-fulfillment of our contractual obligations, limited to three times the contractual total price.

10. Indemnification

The participant indemnifies and holds Drivers Point GmbH harmless from all claims related to the execution of driving safety training.

11. Miscellaneous

11.1 The place of jurisdiction is the company’s seat in 1210 Vienna. If not permissible, the statutory place of jurisdiction applies.
11.2 Should any provision of these Terms and Conditions be invalid, void, or unenforceable, this shall not affect the validity of the remaining provisions.
